1. RETURNS, REFUNDS AND EXCHANGES POLICY
1.1 Please note that once we have accepted your order, you cannot return the product and seek a refund or exchange because you have simply changed your mind. We will, however, accept returns and provide you with a refund if you are able to provide us with proof of purchase, and proof that the product:
(a) is not of acceptable quality; or
(b) is not fit for its intended purpose; or
(c) does not match the sample or our description.
1.2 If a product arrives damaged, please contact KYD immediately and we will arrange for the damaged product to be returned to us and a replacement to be issued.
1.3 If you are entitled to a refund under these terms, refunds can only be made to the credit/debit/charge card that was used for the original purchase – unless it has expired, in which case we will contact you.
2. MEMBERSHIP TERMS—DIGITAL-ACCESS MEMBERSHIPS & BUNDLE MEMBERSHIPS (DIGITAL ACCESS + PRINT COPY OF NEW AUSTRALIAN FICTION)
2.1 Your membership grants you access to the full catalogue of our magazine content in digital form, as well as a range of other discounts. Bundle memberships additionally include a copy of New Australian Fiction (published annually on 1 September). Bundle memberships purchased up to and including 15 August will receive the New Australian Fiction edition from the previous year. For example, a bundle membership purchase on 10 July 2023 will receive a copy of New Australian Fiction 2022.
2.2 You may access this catalogue by logging into the KYD website at the top right of the homepage. In order for us to provide you with your digital membership, it’s vital that you hold a compatible device, email address and internet access.
2.3 By submitting your payment and other membership details, you are making an offer to KYD to buy a membership. Your offer will only be accepted by us and a contract formed when we have successfully verified your payment and contact details, at which point we will provide you (or, in the case of a gift membership, the recipient of the gift) with access to the membership. You will receive written confirmation when your membership offer has been accepted (beginning the fulfilment of a membership does not signify acceptance).
2.4 All memberships are set to automatically renew on a yearly basis. Please refer to clause 3 below to find out how you can handle your memberships, including if you would like to convert to manual renewing.
2.5 At the end of a manual renewal membership, or upon terminating any other membership in accordance with clause 3, if you choose not to renew, you will lose access to the KYD catalogue, and will need to join again in order to regain your access.
2.6 For renewed bundle memberships, KYD will send the relevant edition of New Australian Fiction within 5 working days of your renewal.
2.7 Renewing members are responsible for updating their postal address in their account dashboard. KYD is not obligated to send replacement copies of New Australian Fiction to addresses that are no longer current. If you are having trouble updating your postage address, please contact KYD.
3. PRICING, PAYMENT AND RENEWAL
3.1 By purchasing a membership, you agree to the price and also the billing frequency stated at the time of your order.
3.2 Prices for memberships are in Australian dollars and GST-inclusive.
3.3 Please note that all payments are made in advance and we accept payment through Visa or MasterCard. It is your responsibility to provide valid payment details, and ensure that your payment details are up to date. To change your credit card details in your account, please follow these steps.
3.4 All memberships will automatically renew at the time of purchase until you notify us to stop. You can easily change your automatic renewal membership selection to a manual renewal membership selection by changing your preferences in your account, or by contacting us.
3.5 For manual renewal memberships, we will contact you at the end of the initial membership period with an offer to renew your membership. This renewal will need to be actioned in your account. You may cancel your membership at any time as set out below in clause 3.9.
3.6 For automatic renewal memberships, 7 days prior to the end of your membership period we will send you a reminder notice that will indicate when renewal is due to occur. If you do not notify us to stop the renewal, your credit or debit card will automatically be charged for the period described in the reminder notice. By purchasing a membership that automatically renews, you agree and authorise us to debit your credit or debit card via our payment processor. This authority will remain valid until you notify us to cancel your membership in accordance with clause 3.9.
3.7 For automatic renewal memberships, you must provide valid payment details to our payment processor at the commencement of your membership that can be direct debited at time of the renewal. You can update your payment details at any time via your account dashboard.
3.8 In the event that your payment details are invalid or you do not contact us prior to the renewal, your membership will be revoked and you will no longer have access to the magazine and associated benefits of membership.
3.9 You can notify us to cancel your membership and thereby stop the renewal via your account dashboard or by contacting KYD.
3.10 We reserve the right to change the prices and fees at any time. In the event your membership fee changes, you will be given at least 14 days notification prior to when you would need to make a decision to cancel and not be affected. The new fees will automatically take place from your next billing cycle.
3.11 When your automatic renewal membership is taken out at a discounted price, the discounted price will not be applied at the time of renewal and instead the membership will renew at the regular membership price current at the time of renewal. You will be notified of this price 7 days before payment is taken.
3.12 You must notify us of cancellation at least 2 business days before your next billing date, otherwise we may not be able to stop your next automatic payment from being deducted.
3.13 If you opt out of receiving any newsletters or other email communications other than those contained in and associated with your membership we will not refund any subsequent membership fees charged unless you have also cancelled your membership in line with this clause. Opting out of receiving newsletters or any other email communication otherwise related to your membership does not constitute the cancellation of your membership.
3.14 KYD reserves the right to suspend or cancel your membership at any time in its absolute discretion. In the event that KYD cancels your membership, you will receive a pro-rata refund for the balance of the term outstanding on your membership from the date of suspension or cancellation.
3.15 You may not share or transfer your membership to another individual or entity, and we reserve the right to refuse your request to share or transfer your membership.
